Player Agreement and Code of Conduct

This year, when making their formal applications to be considered for the Open and Women's teams, players will be required to submit a signed copy of the player agreement and code of conduct. You can download the text here (pdf document) and/or read it below. It is largely based on the player agreement and code of conduct that New Zealand athletes competing in the Olympic Games this year will have to sign.

PLAYER AGREEMENT
2012 ISTANBUL CHESS OLYMPIAD

BACKGROUND
A. The Player wishes to be considered for selection in the New Zealand Teams that will compete in the 2012 Istanbul Chess Olympiad.
B. Before the Player can be nominated for and selected in the Teams, the Player must enter into this Player Agreement with the NZCF.
C. This Agreement sets out the terms and conditions by which the Player and the NZCF shall operate if the Player is selected in the Teams.

AGREEMENT
1. THE SELECTION PROCESS
1.1 Any Player seeking to be nominated in and selected for the Teams must have:
a) completed and returned to the NZCF by the date specified, their Application for Selection;
and b) completed and returned this Agreement by signing and returning the Player Acceptance form.
1.2 The NZCF then shall make its selections for the Teams from those Players who have signed the attached Player Acceptance form.

2. TERM OF AGREEMENT
2.1 This Agreement will take effect from the Selection Date. If you are not selected in the Teams, this Agreement will not come into effect. If you are selected as a non-travelling reserve, this Agreement will take effect if NZCF calls upon you as a player replacement.
2.2 This Agreement will end (unless terminated earlier in accordance with this Agreement) on the date on which you commence travel to depart from Istanbul at the conclusion of the Chess Olympiad.
2.3 The dates and venue for the Olympiad are at the final discretion of FIDE and the Olympiad Organiser. NZCF does not have any control over changes to these. This agreement will remain in effect for all reasonable changes to the timing and location of the event.

3. YOUR OBLIGATIONS
3.1 During your participation in the 2012 Chess Olympiad in Istanbul, you agree to:
a) abide by the FIDE Laws of Chess and the regulations relating to the Istanbul Chess Olympiad.
b) train and prepare yourself to the best possible state to enable you to compete in the Chess Olympiad to your highest possible standard;
c) immediately advise the NZCF if any of the declarations made by you in your Player Application are no longer correct or accurate. You acknowledge the NZCF may terminate this Agreement if the eligibility requirements for nomination and selection in the Teams are not satisfied as a result of such matter;
d) comply with all reasonable directions of, and arrangements made by the Team Manager and Captain or any other person appointed by the NZCF including directions in relation to travel arrangements in Istanbul, security, and accommodation;
e) comply with the Player Code of Conduct attached to this Agreement;
f) conduct yourself in a manner befitting a sports person representing New Zealand;
g) not act in any manner which brings or could potentially bring yourself, the NZCF, sponsors, chess, or the Teams into disrepute;
h) accept and comply with all decisions made by Team Management in relation to team selections.
3.2 You acknowledge that if at any time during the Term of the Agreement you are convicted of any serious offence then you will be considered to have materially breached this Agreement.
3.3 You will endeavour to participate in and assist with Olympiad fundraising and promotional activities organised by NZCF to the extent that you are able to make yourself available and it is logistically possible.
3.4 You will annotate at least one of your Olympiad games within a month of the conclusion of the Olympiad and submit it to NZCF for publication as NZCF sees appropriate.
3.5 You will be responsible for the organisation and payment of your travel to and from Istanbul in order to be at the Olympiad for the full duration of the event. You will also be responsible for your personal travel insurance.
3.6 You are responsible for ensuring that your travel documentation including passport and any necessary visas are current and valid.
3.7 You are responsible for providing your own equipment and materials for chess preparation at the event. This includes computer, chess databases, and books.

4. OBLIGATIONS OF NZCF
4.1 For the Term of this Agreement, the NZCF agrees to:
a) select the Teams in accordance with its selection procedures and if you are selected, notify you of your selection;
b) provide a Team Manager and Team Captains to provide necessary support to the Teams and to represent the NZCF at the Olympiad;
c) obtain relevant information from you and correctly complete your entry requirements for the Olympiad;
d) assist you with information and any possible logistic support in the arrangement of travel to and from Istanbul;
e) determine and arrange your accommodation at the Olympiad for the period 27 August to 10 September 2012;
f) inform you of the necessary arrangements referred to in this Agreement by various means including email and the NZCF website;
g) arrange fundraising activities to support player travel expenses.

5. MEDIA AND INTERNET GUIDELINES
5.1 For the Term of this Agreement, you:
a) Are entitled to make public comment relating to your personal involvement with the Olympiad providing those comments or communications comply with the remainder of this clause;
b) Are not to make or endorse any public statements that may have a negative effect on any member of the actual or potential Teams either at or in the build-up to the Olympiad;
c) Acknowledge and accept that the spokesperson on all matters concerning the Teams is the Team Manager;
d) Are not to make public statements or comment before or at the Olympiad relating to team selections.

6. SPONSORSHIP AND FUNDING
6.1 NZCF will make every endeavour to work in collaboration with team members to raise funds to assist with travel expenses to and from Istanbul for players and team captains.
6.2 Any funds raised, sponsorship gained, or grants received will be distributed equally by NZCF between players and team management, provided this does not exceed the limit set by 6.3 below.
6.3 No participant shall receive a contribution from fund-raising of an amount greater than their actual direct travel costs to and from Istanbul.
6.4 NZCF will make an allocation and payment of any funds raised after completion of the Olympiad.

7. TERMINATION OF AGREEMENT
7.1 This Agreement may be terminated prior to the end of the Term of the Agreement by:
a) The NZCF terminating this Agreement and withdrawing your selection to the Teams, by giving you notice to that effect, if it has established that you have significantly breached the terms of this agreement;
b) written agreement between you and the NZCF;
or c) NZCF determining, in its sole discretion, to withdraw the Team(s) from the Olympiad.

8. INSURANCE/INDEMNITY
8.1 The NZCF will not be responsible for travel and public liability insurance for members of the Teams.
8.2 You understand and acknowledge that:
a) The NZCF (which for the purposes of this clause includes its members, officers, staff, and members of the Teams) will not itself be liable to you for any loss, damage or injury of any kind to you or your property arising from or in connection with any act or omission of any person (including the NZCF) unless it arises as a direct result of a deliberate and wrongful act or omission by the NZCF;
and b) You release and indemnify the NZCF from any actions, proceedings, claims and damages (including all legal costs and other expenses) which may be taken or made against the NZCF or incurred or become payable by the NZCF arising out of any breach by you of the terms of this Agreement or otherwise arising from any unlawful, reckless, criminal or negligent acts or omissions by you .

9. EFFECT OF OTHER DOCUMENTS
9.1 The Player Application completed by you is deemed to be incorporated into this Agreement. You confirm by signing the Player Acceptance form, that the information you stated in the Player Application remains true and correct and that no matter has arisen that may or does affect the declarations made by you in that document.

10. PRIVACY
10.1 The NZCF will need to collect personal information from you including your contact details (Personal Information).
10.2 Other Personal Information will be collected for the purposes of arranging accommodation, and administrative matters associated with your membership of the Teams.
10.3 By signing this Agreement, you agree to the NZCF collecting your Personal Information, and using it and storing it indefinitely, for the purposes set out in this Agreement.
10.4 Your Personal Information will be kept confidential and not collected, stored, used or shared, for any reason except as expressly provided in this Agreement.

PLAYER CODE OF CONDUCT

I will:
  • never argue with an official. If I disagree with a decision I will inform the Team Captain in order that the decision can be appealed in the appropriate way if the Team Captain agrees that an appeal is justified.
  • control my temper. I understand that verbal abuse of officials and other players or deliberately distracting or provoking an opponent is not acceptable or permitted behaviour in any sport.
  • work equally hard for myself and my team.
  • if required support and assist my team members and the team captain in any way possible when I am not selected to play.
  • treat all players and team members as I like to be treated.
  • cooperate with my team captain, team mates and match officials.
  • display modesty in victory and graciousness in defeat.

I will not:
  • by means of alcohol or any other legal or illegal drug, intoxicant or behaviour, render myself unfit to play on any designated match day, regardless of whether or not I am selected in the team on that day.
  • undermine or damage the confidence or morale of fellow team members or team management.
